(1) The Commission shall recommend candidates in the list of alternate candidates for appointment in the order of merit in the following cases:-
(a) If the candidate recommended for appointment does not receive the letter of appointment within thirty days from the date of receipt of the notice of appointment or the date of publication of the notice,
(b) If the candidate recommended for appointment dies within one year from the date of recommendation or resigns from the post for which he has been appointed or the post for which he has been appointed becomes vacant in any other way.
(2) In case of a situation as per clause (a) or (b) of sub-rule (1), the Judicial Council shall inform the Commission within seven days from the date of vacancy.
